Welcome to Lulu's Little Aviary.
These Terms of Service apply when you visit, browse, communicate with, make an enquiry through, or purchase from the Lulu's Little Aviary website.
Our online store is powered by Shopify.
By using this website, you agree to these Terms of Service together with our Privacy Policy and Returns, Refunds & Rehoming Policy.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
1. Using Our Website
You may use this website only for lawful purposes.
You must not use the website to:
engage in fraudulent, misleading or unlawful conduct
transmit malware, viruses or other harmful material
attempt to gain unauthorised access to the website or associated systems
interfere with the operation or security of the website
impersonate another person
harvest personal information
send spam or unsolicited commercial messages
use automated systems to abuse, disrupt or circumvent security measures, including CAPTCHA or anti-spam systems.
We may restrict access to the website where reasonably necessary to protect the website, Lulu's Little Aviary, our customers or other users.

When making an enquiry, placing an order or otherwise using the website, you agree to provide information that is accurate and reasonably complete.
You are responsible for ensuring that the contact information you provide is correct so that we can communicate with you about your enquiry or purchase.
If customer accounts are available, you are responsible for keeping your login details secure.
3. Live Birds
Live animals require different considerations from ordinary retail products.
Information about available birds, including species, mutation, sex, age, temperament, development and availability, is provided as accurately as reasonably possible based on the information available at the time.
Birds are living animals and may develop or change in appearance, behaviour, temperament and personality as they mature.
Any specific representations made about a bird as part of a sale remain subject to your rights under the Australian Consumer Law.
Availability may change before a purchase or reservation is confirmed.
Collection or handover arrangements for live birds will be agreed with the purchaser separately, with the welfare of the bird taking priority.
After a bird has been handed over, the purchaser is responsible for providing appropriate housing, nutrition, enrichment, supervision, veterinary care and general welfare.
This does not remove or limit any rights the purchaser may have where a bird did not meet an applicable consumer guarantee at the time of supply.
4. Australian Consumer Law
Products purchased from Lulu's Little Aviary, including live birds where applicable, may be protected by automatic consumer guarantees under the Australian Consumer Law.
These guarantees include requirements that goods:
are of acceptable quality
are reasonably fit for an applicable disclosed purpose
match their description
match any sample or representation where applicable.
Your rights under the Australian Consumer Law apply regardless of anything elsewhere in these Terms.
Nothing on this website should be interpreted as stating that refunds, replacements or other remedies are unavailable where the Australian Consumer Law requires them.
Our voluntary policies, guarantees or support commitments operate in addition to your statutory rights.
5. Orders
Submitting an order does not necessarily mean that the order has been accepted.
We may need to confirm availability, payment or other relevant information before accepting an order.
If we cannot supply something you have paid for, we will contact you and provide an appropriate resolution, including a refund where required.
We may refuse or cancel an order where there is a genuine reason to do so, including:
an item or bird no longer being available
an obvious pricing or listing error
suspected fraud or unauthorised payment
circumstances creating a significant welfare or safety concern.
If we cancel an order after payment has been taken and no goods or services have been supplied, amounts owing to you will be refunded.
6. Prices and Payment
Prices displayed on the website are in Australian dollars unless clearly stated otherwise.
Prices may change from time to time. Changes do not affect an order that has already been accepted unless agreed with you or permitted by law.
Any delivery, postage or other additional charges that apply to an order will be disclosed before the purchase is completed where reasonably practicable.
Payments made through the website are processed using payment services provided through Shopify and its payment partners.
You must only use a payment method that you are authorised to use.
7. Physical Product Delivery
Where physical products are available for delivery, estimated delivery times are provided as a guide and may be affected by circumstances outside our reasonable control.
If there is a significant problem with delivery, please contact Lulu's Little Aviary so the matter can be investigated.
Nothing in this section limits any rights you may have where goods are lost, damaged, not delivered or otherwise fail to meet an applicable consumer guarantee.
8. Returns, Refunds and Rehoming
Returns and refunds are handled in accordance with our Returns, Refunds & Rehoming Policy and the Australian Consumer Law.
Our change-of-mind policy for eligible physical products is separate from your statutory consumer rights.
Live bird rehoming through Lulu's Little Aviary's ongoing support arrangements is also separate from a legal entitlement to a refund.
9. Bird Care and Educational Information
Information about birds, hand raising, feeding, husbandry, training, behaviour or health provided through this website is intended as general educational information.
It is not a substitute for individual veterinary diagnosis or treatment.
Birds can become seriously unwell quickly. Where you are concerned about the health of a bird, appropriate veterinary advice should be obtained from a qualified veterinarian, preferably one experienced with avian medicine.
10. Website Accuracy
We make reasonable efforts to keep information on the website accurate and current.
Occasionally information may contain errors or become outdated, including information relating to prices, availability, descriptions or photographs.
We may correct genuine errors or update website information when necessary.
If an error materially affects an order you have already placed, we will contact you and deal with the matter fairly and in accordance with applicable law.
11. Photographs and Product Appearance
Photographs are provided to help represent birds and physical products as accurately as reasonably possible.
Colours may appear differently depending on lighting, photography and device display settings.
Live birds may also change significantly in appearance as they grow, feather and mature.
12. Intellectual Property
Unless otherwise stated, the text, branding, graphics, photographs, videos, designs and other original content published by Lulu's Little Aviary are owned by or licensed to Lulu's Little Aviary.
You may view and use website content for ordinary personal purposes.
You must not reproduce, publish, sell, commercially exploit or falsely represent Lulu's Little Aviary content as your own without permission, except where permitted by law.
Third-party trademarks and content remain the property of their respective owners.
13. Reviews, Photos and Other Content You Submit
If you voluntarily provide a review, testimonial, photograph, comment or other content for publication, you confirm that you have the right to provide that material.
We will not claim ownership of your content.

Those services operate under their own terms and privacy practices.
We are not responsible for the content or operation of a third-party website that we do not control.
15. Shopify
Lulu's Little Aviary's online store is powered by Shopify.
Shopify provides the technology used to host and operate the online store, but purchases made from Lulu's Little Aviary are transactions between you and Lulu's Little Aviary.
Shopify may separately process information relating to your use of the store in accordance with Shopify's own terms and privacy practices.
16. Privacy
Personal information collected through the website is handled in accordance with our Privacy Policy.
Our Privacy Policy explains what information may be collected, how it is used and disclosed, and how you can contact us about a privacy concern or request.
17. Consumer Guarantees and Liability
Nothing in these Terms excludes, restricts or modifies:

any consumer guarantee
any statutory right or remedy
any liability that cannot legally be excluded or limited.
To the extent permitted by law, Lulu's Little Aviary is not responsible for loss or damage caused by circumstances outside our reasonable control or by the misuse of a product after it has been supplied.
Any limitation of liability in these Terms applies only to the extent permitted by applicable law.

We may update, change, suspend or discontinue features or content on the website from time to time.
We may also update these Terms when our services, business practices or legal obligations change.
The latest version will be published on this website together with the date it was last updated.
Changes will not remove rights that have already arisen under applicable law.
